Share this urgent information with everyone you know. Especially your fence sitting owners who should do a short sale immediately so their closing happens this year…while the act is still in effect. Remember, 4 million Americans have already lost their homes to foreclosure, 6 million owners are currently delinquent and about 11 million homeowners owe more than their homes are worth. Mortgage Debt Forgiveness Act allows owners to exclude up to $2 million in forgiven mortgage debt from their income. To qualify, that debt has to be for your primary home — sorry, no vacation homes or investment properties. Without the Mortgage Debt Forgiveness Act cancellation of debt, including mortgage reduction, is generally taxable. That means if the lender takes a $100,000 loss on your home sale and you’re in the 28 percent tax bracket, you’d owe $28,000 in federal taxes on the “income”. Only the funds that you spent buying or improving your home count. So if you took extra cash out of your house during a refinancing or with a home-equity loan, spent it on vacations or on your kids’ college educations and then ran into trouble, you’re out of luck. If you put part of the money into your home and spent the rest elsewhere, you’ll need to be able to track those amounts. Recourse or Non-Recourse Mortgage? Although you may think you’ve finished the deal, if you live in a “recourse” state, in which the bank can come after you for the amount you owe beyond what the asset is worth, you may remain on the hook for years after the fact. In 41 states and the District of Columbia, lenders can sue for the balance of the debt long after the house is gone.

Nashville TN – Unique properties usually have a "love it" or "hate it" aspect to them. A great example is pool homers.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure. Some buyers want a home with a pool. They are willing to spend $20,000 to $50,000 more for a home with a pool. Other buyers absolutely do not want a pool. "Don't show me any pool homes", they tell their agent. If those buyers are not going to like the pool home once they see it, then what is the use trying to hide it. Show it off. That is why a pool home should be marketed loud and clear as a "pool home." The same goes for other unique properties, such as waterfront properties. Another good example is a home that backs up to a power line. A power line is a huge negative for most buyers. But, it is a big plus to other buyers. I heard a story about a home that backed up to power lines. The sellers had a hard time selling it. They finally hired an agent that knew a certain home buyer would like it. The perfect buyer for that home is a family that loves ATVS. They could ride their ATVs on the power line easement. Most roads and neighborhoods are unfriendly to ATV riders. The power line gave them miles of trails to ride without being harassed. A third example is homes located down a dirt road. These homes appeal to people with horses because the dirt road is a great place to ride a horse. They don't appeal to people without horses (who wants to live down a dirt road?) This is why a home down a dirt road needs to be marketed to horse owners. If you have a unique home, then you need an agent who can market it properly. More than likely, your home's unique features need to be proclaimed loud and clear. In a few other cases, they don't. A good, experienced realtor will know what to do. Nashville TN – Here is a story that illustrates this point. An agent I know was hired to sell a 30 acre tract of land.
Several months earlier they had spoken with a buyer that was looking for a similar property. Click here to discover how other sellers successfully did a short sale and avoided foreclosure. However, the buyer had said they were looking for something closer into town. So the agent never told them about the 30 acres. Another agent did tell them about it. They notified the buyers about the property and they decided to buy it. In this case, the seller was fortunate that the property sold. But, it illustrates the importance of a realtor marketing their homes to their active buyers. Those buyers already know and trust that realtor. They are the most likely prospects to buy the homes that agent has for sale. I can help you short sale your property and get back on your feet. Send me an e-mail atnashvilleshortsalepros@gmail.com. Nashville TN – This MLS Mistake could cause the right buyer to never look at your home in the first place. The Multiple Listing Service (MLS) is the first place an agent representing a buyer is going to look for homes for sale.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
(The Multiple Listing Service, which I will call MLS for short, is
the database of homes for sale that all realtors in a certain area
share.
When an agent has a buyer and their own homes for sale won't fit that buyer's needs, then they search the MLS.
If another agent has a home that fits that buyer's needs, then they can sell the other agent's listing.)
In today's market agents have a lot of homes to pick from. Ten,
twenty, thirty, and sometimes even a hundred homes fit their buyer's
criteria. But, they will usually only show that buyer 5-7 homes at one
time.
If these agents don't pick your home from their MLS search, then you
just missed a potential buyer. Here are a few reasons that certain homes
get skipped over in the MLS search.
Reason #1: The main picture of the house is ugly or unattractive. The agents are usually scanning thru lots of listings and don't have time to look at all the pictures.
If the main picture is unattractive, then they will pass on showing the home.
Reason #2: The property is put into the MLS wrong. For example, many MLSs have a search function for the size of the lot.
The agent puts in 0 acres for the lot size. The house will not show
up when an agent searches for a lot size between .5 acres and 1 acre.
Nor will it show up in any other search that has a specific lot size.
This might not be a big deal if you don't have a lot with a bigger than
normal yard.
But, I can tell you from specific experience that this will hurt your
sale if you have a larger than normal lot. There are many other MLS
mistakes, but this is a specific example to show you how it can affect
you.
Reason #3: You don't price your home at $25,000 increments. Most buyers use $25,000 increments when searching online.
For example, they will search for a home priced between $200,000 and
$250,000. If your home is priced at $250,000, then it will show up in
multiple searches.
A $250,000 home will show up in a search for homes priced $200,000 - $250,000 and a search for homes priced $250,000 - $300,000.
This increases the likelihood of the right buyer seeing your home in
the search results and therefore the likelihood of your home selling.

Nashville TN – A lot of agents think buyers don’t like short sales. This
is not true. In fact, many buyers prefer foreclosures and short sales
over normal homes on the market.
They know that they are more likely to buy a home at a fair price when they buy a short sale.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
We never have a problem getting buyers interested in our short sale listings. We have even had buyers fight over certain short sales.
In one instance, we received multiple offers on a property. The property had extra features that these buyers really wanted.
To the average buyer, the features didn’t mean much. But to these buyers they were worth a lot.
So don’t get discouraged if you are thinking of short selling your
house. Short sales are more difficult than the average home sale.
With the help of an experienced short sale agent you can short sell
your house and walk away debt free. Many other people have already done
it. Why not join them?

Nashville TN – Doesn't it annoy you when you hear a large national
bank's hold music tell you that they care about their customers?
Their hold music sings their praises: "We are (Insert your bank's
name) appreciate your business. We offer the best customer service in an
effort to earn your business."
If you ever feel we are not upholding the standard of excellence in customer service, then please let us know", it says.

Arrrrggggghhhhh!!!!! I hate that! If you have ever
negotiated a short sale or loan modification with a large lender, then
you will understand what I am talking about.
They all talk the talk, but they don't walk the walk. Excuse me, but
waiting on hold for 30 minutes does not count for excellent customer
service.
Losing my short sale paperwork for the tenth time doesn't qualify
either. Nor do the loan mod horror stories I hear from sellers who have
finally given up. Banks, please get your act together!
Fortunately, we can still get short sales approved, despite the bad
customer service. This causes some agents to avoid short sales, but it
doesn't stop us.

Nashville TN – The Stop Foreclosure Institute recently received a question from Brett. Here was Brett's question.
"How is the short sale process different for a homeowner versus a rental
property? Is the owner of a rental property more likely to have a
deficiency judgment and/or be taxed on the deficiency than a someone
short selling their own home? Brett."
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
Here was our answer to Brett's question. Yes, short selling a rental property is much different.
(The scenarios below are for a property you bought as a rental, not a
property you bought to live in and then started to rent out.)
1. Deficiency. In most cases, you will not
be dealing with the lenders who will allow you to walk away from the
debt. Lenders are going to ask for a promissory note or deficiency much
more often on a rental.
You can still short sell without a deficiency, but it won't be as easy to do it.
2. You are more likely to owe income taxes.
Uncle Sam isn't giving you the same break on cancellation of debt
income waiver that a normal homeowner gets.
Check with your accountant on methods that can help you wipe out even this debt.

Nashville TN – The Stop Foreclosure Institute recently received a question from Ryan. Here was Ryan's question.
"I own a rental house. When I bought it, the rent covered the
mortgage and all the other payments. However, rental rates have declined
in my area and the rent no longer covers the mortgage.
Besides that, I had to write a big check to fix the roof and carpet. i
am sick of the money drain. Besides that, I am now upside down because
the housing market has taken a dive here.
Can I short sale this house? I am concerned that if I do, then my
lender will come chasing me for the loss. Let me know what you think.
Ryan."
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
Here was our answer to Ryan's question. Ryan, we do think you should try a short sale on the house.
It sounds like the only thing holding you back is wondering whether
or not you will have to repay the bank for the loss. We think you have a
better than 50% chance at not repaying them a dime.
In addition, you can probably negotiate that amount down. For
example, a homeowner we recently helped had to repay $20,000 when the
bank lost over $120,000.
That is right. They wiped out a $120,000 debt for only $20,000. Besides, they had 10 years to repay that $20,000.
However, when you compare the interest they would have repaid on that
$120,000, they saved even more (close to $193,000 after you add in
interest.)
So try out a short sale. With a little creativity and the right
person negotiating for you, you have a good chance at walking away from
that monthly cash drain.

Nashville TN – Many times you will feel pressure to reply right away to
an offer. But, that doesn’t mean that you shouldn’t negotiate.
Buyers are impatient and if they really like your house, then they
will want an answer to their offer right away. But, you know what else
that means?
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
It also means they are probably willing to pay more for your
property. Take the time to talk to your realtor. You need to take a
little time and consider the situation.
Have you been able to find out any information on the buyers? Use
that to put yourself in the buyer's shoes. A little space and an
objective third part will lead to more effective decision making.
Yielding to pressure and making a rash decision can cause you to lose
money. You might just accept the buyer’s offer as is and miss out on
the extra money they were willing to pay for your home.
Thinking about a short sale? I can help you short sale your property and get back on your feet. Send me an e-mail at nashvilleshortsalepros@gmail.com. I will contact you for a free consultation.

Nashville TN – Short sales can take a long time. The banks are difficult
to deal with and many agents do not understand short sales and don't
know what they are doing.
Because of this, many buyers shy away from short sales. Or, if they
do make an offer, then they still continue to look at other properties.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
If a better home comes on the market, then they will buy that home. Few fully commit themselves to purchasing that home.
Because of this many agents recommend leaving a short sale on the
market, even when there is a contract in place. Recently, Bank of
America even changed their policies specifically for backup short sale
offers.
In my opinion, taking your home off of the market when we have an
accepted contract is a mistake. The only exceptions are when the buyer
puts up a large down payment or falls in love with a unique home.
We recommend keeping the home on the open market. All agents and
buyers will be told there is a contract on the property and that they
will be in backup position.
If the buyer really likes the house, then they will submit a backup
offer. The whole process is frustrating and not straight forward.
But, we make the best of the situation and do what we can to make the process easier.

Nashville TN – What is your final goal? You want to sell your property
quickly for top dollar, right? Keep that goal in mind during the entire
negotiation.
I have seen people kill a potential sale to a person that would have
been willing to pay top dollar for a property because they didn't like
the person. Or, the buyer started negotiations with a low ball offer and
the seller got offended.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
"I refuse to negotiate with someone who insulted me with that lowball
offer", they said. And a good buyer moved on to buy another house. Most
buyers with lowball offers can be negotiated to a higher price.
Some buyers have a big ego and think they are great negotiators (when they actually aren't.) What is their definition of a great negotiator?
They think that someone with a big ego that tells people off and
walks around like they own the world is a good negotiator. They think
that being abrasive and rude will get them a better deal. They'll throw
around "take it or leave it" offers.
I can tell you from person experience that most buyers are willing to pay more than their "take it or leave it" offer. You just have to keep the negotiations going, even thought you might be a little unhappy or angry with what they are doing.
I have seen home sellers tell off a buyer that said something rude.
That buyer could have bought their house. The buyer might actually be a
very nice person. Keep your eye on the goal and don't get distracted by
petty things.
You want to sell your house for top dollar. Let anything a buyer says
that is rude, or otherwise offensive, roll off like water off a duck's
back.

Nashville TN – Many buyers will ask what your bottom line is. They know
that they can usually negotiate a home seller down to an even lower
price.
Don't fall for it. You've already made the first move by setting a
price for your home. Tell the buyers that you need to think it over and
get back to them.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
Then, ask them what they like about your home. If they tell you, then
you can determine their motivation to buy your home. After that, ask
them what they are thinking of offering on your home.
The reason this rule is so important is that in some negotiations you
may offer more at the beginning than the other party is willing to
accept. Here is an example of this.
A person I know was trying to buy something. He had a price in mind
that he was willing to pay. He thought the best price he could get was
$1,500, but he was willing to pay up to $2,000.
He asked the seller what he wanted for the item. The seller responded
that he didn't know what he wanted. He offered the seller $1,500 and
the seller accepted it.
Later on he learned that the seller was desperate. The seller had a
price in mind of $800 to $1,000. If the seller had mentioned an opening
price first, then he would have saved $500! Instead the seller made an
extra $500.

Nashville TN – This is the worst sin of negotiating. Don't tell the buyer's or their agent your life's story.
What do you think would pop into a buyer's head if they heard this
out of a seller's mouth? "We must sell the home because it is in
foreclosure and if we don't sell it be June 23rd, then the bank will
foreclose on it."
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
Immediately they will think, "I wonder what they owe on the house. If
it doesn't sell they will have a foreclosure. The sellers probably just
want to get what they owe on the home so they can avoid foreclosure."
This is an extreme example, but it shows you how a simple slip of the
tongue could cause a seller to lose a large amount of their hard earned
equity.
A seller facing foreclosure in that situation might be desperate
enough to "get out" with none of their equity just to avoid foreclosure.
But, what if they buyer was willing to pay the market value for the
home? That seller just lost all their equity! When a buyer asks why you
are selling answer them without giving away any extra information.
You could say, "Oh, we would like to move to a smaller home." You
don't need to say much more than that. And don't tell them you must sell
by a certain date to avoid foreclosure!

Nashville TN – Despite what you have been told price isn't the only
reason people buy. Maybe they really like a certain feature in your
home.
They might be willing to pay more because of that feature. Sometimes they might even absolutely love that feature.
They have been home hunting for a while and finally found a home that
met their needs completely. That means they are willing to pay more for
your home.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
If you meet the buyers, then ask them why they are buying a home.
They might tell you that they are being transferred and have to find a
home by a certain date. If you know that, you will be able to negotiate a
higher sales price.
Your agent needs to probe for the buyer's motivation every chance
they get. If the buyers have an agent, then they need to probe that
agent for information.
"Why do the buyers like this home", "Where are they moving from", and
"How does this home compare to other homes" are some of the questions
they should be asking. No, they shouldn't be asking them as bluntly as
that.
But, you can often find the answers in a roundabout way.
For example, your realtor could say, "They will love our town because
of the X (insert a unique feature of your town.) Do they have an X where
they live now?"
That will start the conversation about where they are moving from. You can learn a lot from what the other realtor says.
It can really help with the negotiations. You would be amazed at what some people will tell you.

Nashville TN – Some buyers will think that since your house is a short sale, then they can make any lowball offer.
Many sellers get offended over their offers and turn them away. After going thru many short sales we have actually found that lowball offers are not necessarily a bad thing. Let me explain why.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
So you get the advantage of getting a good deal. Now, I am sure you are asking, “Why are short sales a bargain?”
After you accept the buyer’s offer you have to wait for your lender to approve the short sale. This process can take from thirty to ninety days.
That gives the buyers lots of time to sell themselves on the house. They drive their friends past it. They drive their parents past it.
“That is the house we are trying to buy”, they tell them. “That’s a nice house. I think you are making a great decision”, their friends and family tell them.
The short sale lender will order an appraisal of the house. They will come back and say that they will not accept a sales price much lower than the appraised value.
We tell the buyers that the short sale lender has ordered and appraisal. The appraisal came back at X, and the lender won’t allow the property to sell for less.
At that point most buyers agree to pay the price. We have seen buyers agree to pay 5-10% more than they had originally offered.
We feel that it is because they had time to “sell” themselves on the house. What do you think? Let me know by commenting below.
